Terms of Service

Welcome to Thrift! These Terms of Service (“Terms”) govern your use of the Thrift mobile application and related services (“App” or “Service”). By using Thrift, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using Thrift, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
Thrift is a mobile application that lets users:
- Buy and sell secondhand clothing and accessories through an in-app marketplace.
- Identify clothing items using AI-powered image recognition and get estimated resale values.
- Find nearby thrift stores.
- Message other users, make and receive offers, and leave reviews.
Thrift acts as a marketplace facilitator: we provide the platform that connects buyers and sellers and facilitates payment, shipping, and payouts. Except where expressly stated, Thrift is not the seller of items listed by users.
3. Eligibility and Account Registration
You must be at least 13 years old to create an account. If you are under 18, you may use Thrift only with the involvement and consent of a parent or legal guardian who agrees to these Terms and is responsible for your activity, including any purchases. You must be at least 18 years old to sell on the marketplace (a requirement of our payment processor, Stripe). To use certain features you must create an account. You agree to:
- Provide accurate information.
- Keep your login credentials secure.
- Notify us immediately of unauthorized access.
- Be responsible for all activity under your account.
You may sign in using email/password, Apple ID, or Google account.
4. Zero Tolerance for Objectionable Content and Abusive Behavior
Thrift has zero tolerance for objectionable content or abusive users. You agree not to post, send, list, or transmit content that is unlawful, fraudulent, hateful, harassing, threatening, sexually explicit, violent, defamatory, or otherwise objectionable, and not to harass, abuse, or harm other users.
To keep the community safe:
- Filtering & blocking. You can block any user, which hides their content from you and prevents them from messaging you.
- Reporting. You can report content, users, orders, and reviews directly in the App.
- Action within 24 hours. We review reports of objectionable content and abusive behavior and act on them, typically by removing the offending content and ejecting the offending user within 24 hours.
We may remove content and suspend or terminate accounts that violate this section, with or without notice.
5. Marketplace Terms
5.1 Buying
- When you purchase an item, your payment is captured and held securely until the order is delivered (or you confirm receipt), at which point funds are released to the seller.
- You agree to provide an accurate shipping address. Title and risk of loss pass to you on delivery.
- Purchases are covered by our Buyer Protection Policy (Section 5.5).
5.2 Selling
- You may only list items you own and have the right to sell, and your listings must be accurate (brand, size, condition, defects, authenticity).
- You may not list prohibited items (see Prohibited Items Policy, incorporated below).
- To receive payouts, you must complete Stripe Connect identity verification (KYC). Payouts are disabled until verification succeeds.
- You must ship sold items promptly using the prepaid in-app label. Orders not shipped within the stated window may be automatically canceled and refunded to the buyer.
- Selling on Thrift is additionally governed by the Seller Agreement (incorporated below).
5.3 Fees and Payouts
- Thrift charges sellers a platform fee as disclosed at the time of listing or sale. Shipping charges are passed through.
- Funds are held by the platform until delivery and then transferred to the seller’s connected Stripe account, less applicable fees and label costs.
5.4 Payments and Taxes
- Marketplace payments and seller payouts are processed by Stripe. By transacting, you agree to Stripe’s applicable terms. Thrift does not store your full payment card or bank details.
- As a marketplace facilitator, Thrift may calculate, collect, and remit applicable U.S. sales tax via Stripe Tax. Sellers are responsible for their own income taxes and may receive a Form 1099-K from Stripe if they exceed IRS thresholds.
5.5 Buyer Protection, Refunds, and Disputes
- Buyer purchases are protected if an item is not received or not as described, as detailed in our Buyer Protection Policy (incorporated below).
- To request a resolution, open the order and tap Report a problem within the stated claim window. Outcomes may include a full or partial refund or a return.
- Sellers agree to cooperate with claims and to accept reversals for items that are not as described, not delivered, or fraudulent.
5.6 Marketplace Policies
Your use of the marketplace is also subject to our Seller Agreement, Buyer Protection Policy, and Prohibited Items Policy. The key terms are summarized above; these policies are available in the App and on request, and they form part of these Terms.
6. Subscriptions and Payments
Free Features
- Thrift store map access and basic browsing.
Premium Subscription (Thrift Pro)
- Unlimited scans with AI-powered price estimates.
- Full map access and additional features as described in the App.
Subscriptions are billed through Apple’s App Store. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions automatically renew at the stated price unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings. Subscription refunds are handled by Apple according to its policies.
7. User Conduct
You agree NOT to:
- Use the App for any illegal purpose.
- Post objectionable, abusive, or infringing content (see Section 4).
- List prohibited items or misrepresent items you sell.
- Arrange transactions off-platform to evade fees or buyer protection.
- Attempt to circumvent usage limits or security measures.
- Interfere with or disrupt the Service.
- Reverse engineer or attempt to extract source code.
- Use automated systems to access the Service.
8. AI-Generated Content Disclaimer
IMPORTANT: Price estimates and item identifications are generated by artificial intelligence and are provided for informational purposes only.
- Estimates are NOT appraisals or guarantees of value.
- Actual resale prices may vary significantly.
- We do not guarantee the accuracy of AI identifications.
- You should conduct your own research before making purchasing or selling decisions.
We are not responsible for any financial decisions made based on AI-generated estimates.
9. Intellectual Property
The App, including its design, features, and content, is owned by Thrift and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.
User-submitted photos and content remain your property, but you grant us a worldwide, non-exclusive license to host, display, and process them as needed to operate the Service (for example, to display your listings and process scans).
10. Third-Party Services
The App integrates with third-party services (Stripe, Shippo, OpenAI, Firebase/Google, eBay, Apple). Your use of these services through our App is subject to their respective terms and policies.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided “AS IS” without warranties of any kind.
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability shall not exceed the greater of the amount you paid us in the past 12 months or $100.
- We are not responsible for third-party content, services, or for the acts or omissions of other users (including the condition, legality, or delivery of items sold by sellers).
12. Indemnification
You agree to indemnify and hold harmless Thrift and its affiliates from any claims, damages, or expenses arising from your use of the App, your listings or transactions, or your violation of these Terms.
13. Account Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time in the App settings. Pending seller payouts are settled before a seller account is closed.
Upon termination:
- Your right to use the App ceases immediately.
- We may delete your account data, subject to records we must retain by law.
- Provisions that should survive termination will remain in effect.
14. Changes to Terms
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of significant changes through the App.
15. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
